Privacy Policy — Alwways

In compliance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 on Personal Data Protection and the Guarantee of Digital Rights, Alwways (hereinafter, “the App”, “Alwways” or “we”) undertakes to protect and respect the privacy of its users’ personal data.

This Privacy Policy informs users about the processing of their personal data, the purposes of such processing, and their rights.

2. Personal data collected

As part of the use of the Alwways App, we may collect the following categories of personal data:

Identification details

• Name
• Email
• Authentication information
• Age (where provided voluntarily by the user)

App usage data

• Information on user interaction with the App
• Usage preferences
• Date and duration of sessions
• Information on the features used

Technical data

• IP address
• Device identifiers
• Operating system and version
• Activity and error logs
• Analytical and performance data

User-generated content

• Responses to questions and conversations within the App
• Photographs and images
• Memories, stories, texts, notes and any other content provided voluntarily

Payment-related data

Purchases and payments made within the App are processed exclusively via the Apple App Store and Google Play Store. Alwways does not store or have access to the full details of the payment cards used by the user.

3. Purpose of processing

• Service provision: create and manage the user’s account, allow use of the App, generate personalised books and content using artificial intelligence, store and synchronise memories and content.
• Premium payment and access management: manage access to premium features and verify purchases made via the Apple App Store or Google Play Store.
• Service improvement and maintenance: ensure the App works properly, correct technical errors, and improve stability, security and performance.
• Communications: send service-related communications and inform users about updates or relevant issues.
• Regulatory compliance: comply with applicable legal, tax and regulatory obligations.

4. Legal basis for processing

• User consent
• Performance of the contract arising from use of the App
• Compliance with legal obligations
• The controller’s legitimate interest in ensuring the security and proper functioning of the platform

5. Artificial intelligence

Some Alwways features use artificial intelligence services provided by third parties. To generate responses, stories and personalised content, certain conversations and content submitted by the user may be sent to specialised technology providers.

After login or registration, users must accept explicit AI consent before using Titi. OpenAI processes chat messages and optional voice input converted to text.

Alwways does not use user-provided content to train its own artificial intelligence models or to improve its systems without the user’s express consent.

6. Disclosure of data to third parties

Alwways may share personal data with third-party providers necessary to deliver the service, including:

• OpenAI, for AI-generated content
• DigitalOcean, for server and database hosting
• Firebase (Google), for notifications, analytics, authentication and technical features
• Cloudinary, for profile and book cover images
• Apple App Store and Google Play Store, for app distribution and purchase management

These providers will process the data in accordance with their own privacy policies and applicable data protection regulations.

7. International data transfers

Some technology providers used by Alwways may be located outside the European Economic Area. When international data transfers occur, Alwways will take the measures necessary to ensure an adequate level of protection in accordance with applicable law.

8. Data retention

• Data will be retained while the user’s account remains active.
• When the user requests account deletion, their data will be deleted or anonymized within a maximum of thirty (30) days, except where legal retention is required.
• Data related to legal or tax obligations may be retained for the periods required by applicable legislation.

9. Account deletion

Users may delete their account and associated data at any time from the App (Settings → Delete account) or by emailing alwwaysapp@gmail.com.

10. User rights

Users may exercise at any time the rights of access, rectification, erasure, objection, restriction of processing, data portability and withdrawal of consent.

Users may also lodge a complaint with the Spanish Data Protection Agency (AEPD) or the competent supervisory authority in their country of residence.

11. Cookie-like technologies

The App may use technologies equivalent to cookies, device identifiers and analytics tools to improve the user experience, analyse use of the App and ensure proper functioning. Users may limit certain permissions from their mobile device settings.

12. Minors

Alwways may be used by people of any age. Where applicable law requires it, processing of minors’ personal data must have authorization from their parents or legal guardians.

13. Information security

Alwways adopts reasonable technical and organizational measures to protect personal data against unauthorized access, alteration, accidental loss or destruction. However, no storage or transmission system can guarantee absolute security.

14. Changes to this Privacy Policy

Alwways may modify this Privacy Policy at any time. Changes will be published on this page and/or in the App and will take effect from their publication date.
